DX Avenue  General Conditions of Sale (T & Cs)



These present general conditions of sale are agreed between on the one hand the firm BITTIGER P. DX AVENUE, whose registered office is: Lac Ferrier 24420 Sorges FRANCE registered under the French SIRET number 534 919 386 00019 - RCS PERIGUEUX 534 919 386, herinafter referred to as DXAVENUE.COM and on the other hand by all individuals or companies wishing to make a purchase via our website.


ART.1 - Object

The present general conditions of sale are aimed at defining the contractual relationship between DXAVENUE.COM and the purchaser and conditions applicable to all purchases effected by means of the sales website DXAVENUE.COM whether the buyer is a professional or a private individual. The acquisition of a goods or service through this site implies the acceptance without reserve by the buyer of the present conditions of sale. These conditions of sale will prevail over all other conditions general or particular not expressly agreed by DXAVENUE.COM, who reserves the right to modify these conditions of sale at any time. In which case, the conditions applicable will be those in force at the date of the order by the buyer.


ART.2 - Nature of goods and services offered

The products and services are those which appear in the catalogue published on the website DXAVENUE.COM. These products and services are offered within the limit of available stock. The photographs in the catalogue are as accurate as possible but do not guarantee perfect representation of the product(s) ordered.


ART.3 - Tariffs

The prices appearing in the catalogue are in euros inclusive of tax. Every change in the French rate of tax will impact on the price of the products or services. DXAVENUE.COM reserves the right to change the prices at any time, having however understood that the price shown in the catalogue at the time of ordering will be the one applicable to the purchaser. The costs of despatch (including packaging, handling and postal charges) will be clearly shown on the final statement as also the total amount to be paid.


ART.4 - Orders

The purchaser must select, with the aid of the current catalogue, the products which he wishes to acquire and transmit the order to DXAVENUE.COM by means of the purchase proforma available on the website, which he can confirm by following the instructions.
Confirmation of the order indicates acceptance of the present conditions of sale, the recognition of complete understanding of them and the surrender of any claim under his own or other conditions.
The whole of the information given and the registered confirmation will be taken as proof of the transaction. The confirmation notice will serve as a signature to and an acceptance of the transactions undertaken. The seller will communicate by e-mail confirmation of the registered order.



ART.5 - Withdrawal

Purchasers have the benefit of a delay of 7 days from the delivery of their order to withdraw from the sale.

Returned products must be in new condition and in their original unopened packaging. The cost of return will be at the charge of the purchaser. The guarantee "satisfaction or refund" is valid within these terms and conditions of sale.


ART.6 - Method of payment

Payment is required at the time of ordering. Payments by bank card are effected by means of the PAYPAL secured website.
Payment by bank transfer should be made to the order of DX AVENUE and are subject to all necessary clearances. (We do not accept cheques from outside Metropolitan France or the French Overseas Departments and Territories).
Until actual receipt of the whole of the sums due, DXAVENUE.COM remains the owner of all goods delivered and retains the right to proceed to their recovery on default of payment.



ART.7 - Delivery

At the time of ordering several modes of despatch are offered to the customer (as also the costs including taxes). They vary automatically in respect of weight and destination (France, DOM-TOM, European Union, other countries). Parcels are normally shipped by DX Avenue in 48 hours after cleared payment. This delay on delivery can vary depending on difficulties in transportation, stock shortages or holiday periods. If this arises the purchaser will be advised by e-mail.
All risks are accepted by the purchaser counting from the time when the products have left the premises of DXAVENUE.COM.
In event of damage during transport, all claims must be notified by registered letter within 48 hours of delivery.



ART.8 - Liability

No liability will be accepted by DXAVENUE.COM in the event of misuse of the items sold. The descriptions and advice on use such as appear on the DXAVENUE.COM website are indicative and not contractual.
No liability will be accepted by DXAVENUE for happenings beyond their control such as strikes, natural disasters, fires or other.
The seller, in respect of the process of on-line sale,is not subject to any obligation regarding the method: he is not liable for any damage resulting from the use of the internet such as loss of details, interference, virus, breakdown in service, or other unintentional difficulties.



ART.9 - Intellectual property

All elements of the DXAVENUE.COM website remain the exclusive and intellectual property of DXAVENUE.COM.  No unauthorised reproduction, exploitation, redistribution, or any other use whatever, including, particularly, programs, visual or audio elements of the website.


ART.10 - Archiving - Proof of order

DXAVENUE.COM will store the order proforma and the invoices on a reliable and durable back up forming a faithful copy conforming to the dispositions of Article 1348 of the French Civil Code. DXAVENUE.COM’s computerised records will be accepted by both parties as proof of communications, orders, payments and transactions taken place between the parties.


ART.11 - Resolution of disputes

The present conditions of on-line sales are subject to French law. In case of dispute, jurisdiction falls to the competent courts, notwithstanding the numbers of participants or any warranty claims.
